Hello Everyone -
I am trying to understand importance of PD after one files 485. I filed my 485 in Jul 2007 and got FP in Sep 07. Then I got a notice for in person interview with USCIS officer. At the end of interview the USCIS officer indicated that the case is approved but will have to wait for Visa # to get the GC. The interview had happened in the month of Feb when visa for EB2 was Unavailable. My PD is Nov 06 and I am just trying to understand how this process will work.
Will my GC be processed when the dates on visa bulletin will be show have nov 06 or it will just get processed as there is no reason to hold the adjudication? Background check or any other

Guys. Assuming the same set of conditions as being discussed in this thread (Intent to change employers, I-140 already approved etc..)... Would I be able to retain my PD even if I change my field when I move to a new employer (shift from IT to Marketing after getting my MBA).
Any help would be highly appreciated. Thanks.

- My port of entry was Minneapolis/St. Paul.
- Remember to please take ALL originals of the AP that you have (let the officer sort out what to do with them).
- I had I-485 application receipt (or take a copy if you do not have the original) just in case (I did not need it, but why not!).

You could argue that you don't need to have a job now, just that you need to be in a "same or similar"position when the 485 is approved. if your priority date is very backlogged, you have lots of time to find a job.

I am very curious to know if you have been successful in responding to an RFE in the manner you mentioned and USCIS accepted the agrument and continued with AOS for any of your clients. I understand that given the circumstances the OP does not have much of an option since he does not have a job right now. But it would be interesting to know if USCIS has accepted such an argument in the past.

Managed to call 10 on the list (including all representating state of residence). Will call more as soon as the next meeting gets over at work.
General response has been non-committal. Most aides/members of Congressperson's office couldn't/wouldn't share Congressperson's position on the bill. Sounds like a touchy issue for them.

No. I sent my application in June. It was received on June 19th.
Its good to be optmisitic but one thing I have learnt after waiting for so long for my green card is that this process is so screwed up that you can never expected anything that would follow a common sense of logic.

She should go on h4. If she wants her ead she can file once you get AOS receipt No. unless u alreaqy filed for it. If u already filed for her ead you should still wait for her to quit her h1 job till the ead comes through.

In particular the only question which surprised me was when I was asked to descirbe what my job responsibilities are....I was prepared for it and the officer was matching it with the job description used for my PERM
The officer was very nice and helpful. I got done in like 20-25 min and she said that the case is approvable. We just need to wait for the Visa #.

Hey, I would like to help you but I know next to nothing about J-1 Physician waivers. It is a completely different system. My understanding that the best way to get a waiver is to go through the Conrad 30 program if your wife works in a hospital in an underserved area. I would encourage you look through this forum for individuals who would know more about the process. Likewise, I would also suggest that you consult with an attorney. I used one of the best attorney firms in the world and it was relatively inexpensive. Attorneys really do wonders in these cases bacause they understand this process inside and out and know exactly what the Department of State is looking for.

You have a valid point but in worst case scenario, can i use the EAD and handle the RFE at the time of citizen ship... is the RFE during approval of GC or during citizen ship ?
Here is how I see it,
1. You use your EAD and quit your employer.
2. Your H employer cancels your H-1 and therefore the H-4 is cancelled too.
3. When it is time for your wife to apply for AOS, she has show proof that she is legally in the US at that time.
4. But she is no longer in the US legally and so she cannot really apply.
I would not take this route. Instead I suggest you try to get her a different visa (h1, F1, etc) and make her status independent of yours. If not, then you will have to hold on to a H status until her PD becomes current.

Oracle applications, Oracle financials, Siebel, SAP are good fields to enter. Data warehousing is hot and a lot of people get trained. Consulting companies have fulltime trainers and there are a lot of courses you can take.
These are good end points. Start a little more basic to get good underpinnings.
I think, also, that if you don't know what you want to do, go for a BSc. in computer sci. If you do, take specific courses.
For system Admin, I'd recommend Redhat.com's courses. The world is going Linux. Play with it and mess it up. Re-install. All part of the fun. Hack some Bash/Perl scripts.
For coding I'd learn C first. Get good with pointers etc. Then learn Object Orientated PHP or Java. C isn't the easiest of languages, true. If you have problems, fall back to BASIC.
PHP and Java will get you started with web stuff and databases fairly quickly too. Start with Mysql. Then Postgresql. That'll get you ready for Oracle (the database) and you can then learn the applications that run on it.
If you learn the high end apps w/o learning the low end, you're code may be beautifully written but horribly inefficient.
They'll ask why an MBA/HR guy wants to be a grunt. Consider volunteering for an open source project for street cred. sourceforge.net has a bunch of projects.

look at your labor app... it states your proffered wage, job description etc. those are the terms and conditions... you can still get an EVL from your employer and have your lawyer (or have yourself) write a letter explaining how the EVL covers terms and conditions on the labor cert. in any case, this is a really stupid and unenforceable rfe... i mean how can the new employer even know whats in the labor and i-140? and without knowing that how can an employer "indicate" any compliance with t&c of labor and 140? i think you should be fine with just a plain evl that matches your job description and salary... at most, you can write a letter saying that "yeah the t&c continues to be valid".

Hi all,
I am sure there are people here who started the green card application process but also wanted to go to school (e.g., for MBA) during the green card process. Is it possible to get an F-1 visa to attend school full-time while your green card is still pending?
I heard during a lawyer's presentation that it is very hard (almost impossible) to get an F-1 visa if you have started the green card application process, since by starting it, you have declared an intent to immigrate.
However, I have also heard that it is easy to get an F-1 visa even after starting the green card application process, but your green card application will be canceled.
Please let me know if you have any knowledge or experience in this. Thanks.
